Terms of Service

1. Introduction

These Terms & Conditions ("Terms") govern your use of the Epiknight mobile application (the "Application") and the related services (the "Service") operated by Tortoise85 S.L. ("we", "us", or the "Owner"), a company with registered office at Calle el Sauce 9, 38660 Adeje - Tenerife, Spain.

By creating an account or otherwise using the Service, you agree to be bound by these Terms. If you do not agree, you must not use the Service.

2. Eligibility

You must be at least 18 years old and legally competent under the laws applicable to you in order to use the Service.

By using the Service, you represent and warrant that you meet these requirements.

3. The Service

Epiknight is a platform that allows users to discover partner clubs and venues, book tables, manage reservations, and communicate with venues and other users.

When you book a table through Epiknight, a contract for the booked service forms directly between you and the relevant venue. Epiknight acts as an intermediary platform connecting users with venues.

We may add, modify, or remove features of the Service at our discretion.

4. Account registration

To access certain features of the Service you must register an account and provide accurate, complete, and current information.

You are responsible for maintaining the confidentiality of your credentials and for any activity that occurs under your account. You agree to notify us promptly of any unauthorized use of your account.

5. Bookings and payments

Bookings are subject to availability and confirmation by the relevant venue.

Payment is processed through our third-party payment provider. Applicable fees, taxes, and any minimum spend requirements will be displayed before you confirm a booking.

By completing a booking, you authorize the charge of the displayed amount to your selected payment method.

6. Cancellations and refunds

Each booking is subject to the cancellation policy displayed at the time of booking, which may be set by the relevant venue.

Refunds, where applicable, are processed in accordance with that policy and may take several business days to appear on your statement.

We reserve the right to cancel a booking in case of suspected fraud, abuse, or non-compliance with these Terms.

7. User conduct

You agree to use the Service lawfully and respectfully, and not to harass other users or venue staff, post unlawful or harmful content, attempt to access the Service by automated means, or interfere with the operation of the Application.

We may suspend or terminate your access to the Service for violation of these rules.

8. Content and intellectual property

All content provided through the Application (including text, graphics, logos, and software) is owned by or licensed to Tortoise85 S.L. and is protected by applicable intellectual property laws.

You may not copy, modify, distribute, or create derivative works of this content without our prior written consent.

9. User-generated content

If you submit content through the Application (such as reviews, messages, or photos), you grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute such content for the operation of the Service.

You represent that you have all rights necessary to grant this license.

10. Third-party services

The Service may include links to or integrations with third-party services (e.g., venues, payment providers, maps). We are not responsible for the content, terms, or practices of such third parties.

11. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, to the maximum extent permitted by applicable law.

We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components.

12. Limitation of liability

To the maximum extent permitted by law, Tortoise85 S.L. shall not be liable for any indirect, incidental, special, or consequential damages arising out of or related to your use of the Service.

Our total aggregate liability for any claim relating to the Service shall not exceed the amount you paid through the Service in the twelve (12) months preceding the claim.

13. Indemnification

You agree to indemnify and hold harmless Tortoise85 S.L. and its affiliates from any claim or demand arising out of your breach of these Terms or your use of the Service.

14. Termination

You may close your account at any time through the Application.

We may suspend or terminate your access to the Service if you breach these Terms or if required by law.

15. Changes to these Terms

We may amend these Terms from time to time. We will notify you of material changes through the Application. Continued use of the Service after such changes constitutes acceptance of the revised Terms.

16. Governing law and jurisdiction

These Terms are governed by the laws of Spain, without regard to its conflict-of-laws principles.

Any disputes arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the competent courts of Spain, subject to any mandatory consumer protection rights you may have under applicable local law.
